A CHARTER ORDINANCE EXEMPTING THE CITY OF PEABODY, KANSAS, FROM THE PROVISIONS OF K.S.A. 15-106 REGARDING MEETINGS OF THE CITY COUNCIL OF CITIES OF THE THIRD CLASS, AND PROVIDING SUBSTITUTE PROVISIONS THEREFOR; AMENDING SECTION 1-207 OF THE CODE OF THE CITY OF PEABODY, KANSAS; AND REPEALING ORIGINAL SECTION 1-207 OF THE CODE OF THE CITY OF PEABODY, KANSAS.
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF PEABODY, KANSAS:
SECTION 1. By the
power vested in the City of Peabody, Kansas, by Article 12, Section 5, of the
Constitution of the State of Kansas, said City hereby elects to exempt itself
from and make inapplicable to it the provisions established under K.S.A.
15-106, such provisions being a part of an enactment applicable to the City of
Peabody, but not applicable uniformly to all cities.
SECTION 2. The
governing body of the City of Peabody, Kansas, hereby elects that the following
substitute and additional provisions are substituted in lieu of those provided
under K.S.A. 15-106 as follows, and original Section 1-207 of the Code of the
City of Peabody, Kansas, is hereby amended to read as follows:
1-207 QUORUM: ATTENDANCE OF MEMBERS. It shall
require four members elect of the City Council to constitute a quorum to do
business; but a smaller number may adjourn from day to day, and may compel the
attendance of absent members by attachment issued in the name of the city and
directed to the Chief of Police demanding the arrest of such absent members and
the bringing of such members before the Council.
SECTION 3. Original
Section 1-207 of the Code of the City of Peabody, Kansas, is hereby repealed.
