Article 1. Standard Traffic Ordinance

(a)   The Standard Traffic Ordinance for Kansas Cities, prepared and published by the League of Kansas Municipalities, 51st edition, published in 2025, as amended by this article, is hereby adopted and incorporated by reference as a traffic ordinance of the City of Peabody, Kansas, under the provisions of K.S.A. 12-3009 through 12-3012, including any amendments thereto, and K.S.A. 12-3301 and 12-3302.

(b)   At least three official copies of said Standard Traffic Ordinance marked or stamped “Official Copy as Adopted by Ordinance No. 03-2025” and to which shall be on file with the City Clerk of Peabody, Kansas, to be open to inspection and available to the public at all reasonable business hours.

(c)   Traffic Infractions and Traffic Offenses. An Ordinance traffic infraction is a violation of any section of this ordinance that prescribes or requires the same behavior as that prescribed or required by a statutory provision that is classified as a traffic infraction in K.S.A. 8-2118. All traffic violations which are included within this ordinance, and which are not ordinance traffic infractions, shall be considered traffic offenses.

(d)   Penalty for Scheduled Fines. The fine for violation of an ordinance traffic infraction or any other traffic offense for which the municipal judge establishes a fine in a fine schedule shall not exceed $500.00. Maximum term of incarceration is 6 months unless otherwise specified.

Section 33 of the Standard Traffic Ordinance entitled “Maximum Speed Limits” shall be amended to read as follows:

Section 33. Maximum speed limits.

(a)   Except as provided in subsections (b) and (c), and except when a special hazard exists that requires a lower speed for compliance with Section 32, the limits specified in this subsection or established as authorized by law shall be maximum lawful speeds, and no person shall operate a vehicle at a speed in excess of such maximum limits:

(1)   20 miles per hour in any business district;

(2)   30 miles per hour in any residential district;

(3)   15 miles per hour in the City Park;

(4)   15 miles per hour in all School Zones;

(5)   55 miles per hour in all other locations.

(6)   20 miles per hour on 2nd Street from Vine Street to Locust Street;

(7)   20 miles per hour on Locust Street from Spring Creek bridge to 3rd Street;

(8)   20 miles per hour on Division Street between Poplar Street and Locust Street;

(9)   30 miles per hour on 9th Street from Nighthawk Road to Old Mill Road.

(b)   The governing body of the City may from time to time establish speed limits as to particular streets or roadways within the City specifying maximum speed limits that are greater or less than the rates set forth in subsection (a), which such specified limits shall become effective upon their adoption and upon the posting of signs giving notice thereof.

(c)   No person shall drive a school bus to or from school or interschool or intra-school functions or activities at a speed greater than 45 miles per hour on any street or roadway having a dirt, sand or gravel surface, and in no event shall a school bus be driven to or from school or interschool or intra-school functions or activities in excess of 55 miles per hour, notwithstanding any maximum speed limit in excess thereof. The provisions of this subsection relating to school buses shall apply to buses used for the transportation of students enrolled in community colleges or area vocational schools when such buses are transporting students to or from school or interschool or intra-school functions or activities.

(d)   The maximum speed limits in this section may be altered as authorized in K.S.A. 8-1559 and 8-1560, and amendments thereto.

No person, except those expressly exempted, shall drive any motorcycle, motor-driven cycle, motorized bicycle or autocycle upon any highway or street in this city unless such person has a valid driver’s license and said driver’s license is rated for motorcycles or has a class “M” endorsement. Violation of this section is punishable by fine of not more than $1000.00 or by imprisonment for not more than six months or both fine and imprisonment.
