The term “miscellaneous sales” means any garage, basement, yard, rummage or other similar sale of five (5) or more miscellaneous items originally purchased by the seller for his or her ultimate use or consumption.

All miscellaneous sales from or upon residential property shall conform to the following regulations:

(a)   No person as seller, or persons of the immediate family residing with the seller, shall have or conduct more than two (2) miscellaneous sales within a twelve (12) month period and such sale shall be limited to three (3) consecutive days: Provided, that schools, churches and nonprofit organizations may carry on miscellaneous sales for the benefit of the organization only, when such sale is conducted on school or church property, or property of such nonprofit organization.

(b)   Signs advertising such sale must be removed immediately upon the conclusion of said sale.

(c)   Where the sale is conducted on the premises exterior to any structure or residence, or on any vacant lot or tract, all sale items shall be removed from such exterior premises, lot or tract within two (2) days following the day the sale is concluded.

(d)   Prior to a miscellaneous sale being conducted, the seller shall first obtain a written permit from the office of the City Clerk.

Violation of any of the provisions of this article shall constitute a misdemeanor and any person, firm or corporation, upon conviction thereof, shall be fined in any sum not exceeding THREE HUNDRED DOLLARS ($300.00), and each day of the violation shall be considered as a separate offense.
