CHAPTER 1. ADMINISTRATIONCHAPTER 1. ADMINISTRATION\Article 6. Civil Defense

As used in this article the term “Civil Defense” shall include measures necessary to provide for the mobilization, organization and direction of the civilian populace and necessary support agencies to prevent or minimize the effects of enemy or subversive activities against the populace, communities, industrial plants, facilities and other installations.

There is hereby created the office Director shall be provided by law of the Peabody Civil Defense Director; such appointed by the Governing Body of the city, as The duties of the Director are as follows:

(a)   To represent the Mayor in all matter pertaining to civil defense;

(b)   To obtain and utilize cooperation of Peabody officials in the preparation and implementation of civil defense:

(c)   During periods of emergency, to direct the services of all city civil defense forces; and

(d)   During periods of emergency to obtain vital supplies and equipment needed for the protection of life and property, and upon approval of the Governing Body of the city to bind the city for the value thereof, and if required immediately to requisition the same.

Officers and employees of the City with volunteer forces enrolled to aid them during an emergency and all groups, organizations and persons who make agreements on operation of law, and are charged with duties necessary for the protection of life and property in the city during such an emergency, shall constitute the Civil Defense Corps.

The functions and duties of the Peabody Civil Defense Corps shall be distributed among three (3) numbered divisions, to-wit:

(a)   Operations;

(b)   Supporting service;

(c)   Administration.

Each division shall be under the direction of a qualified service chief who shall be appointed by the director.

All persons, other than officers and employees of the city, volunteering for service as provided in this article shall serve without compensation, unless the Governing Body of the city has provided by ordinance for such compensation, and that while engaged in such service such volunteers shall have the same immunities as officers and employees of the city performing similar duties.

It shall be unlawful for any person who during an emergency to:

(a)   Lawfully obstruct, hinder or delay any member of Civil Defense Corps in the enforcement of a lawful or regulation issued pursuant to this article or in performance of any duty imposed upon him by virtue this article; or the rule the of

(b)   Do any act forbidden by any lawful rules or regulations issued pursuant to this article, if such act is of such nature as to give assistance to the enemy or to imperil or delay the protection afforded by this article; or

(c)   Wear, or carry, or display without authority any mark or identification specified by the Director of Civil Defense. Any person violating any of the provisions of this section, shall upon conviction thereof, be punished by a fine of not to exceed One Hundred Dollars ($100.00), or by imprisonment not to exceed three (3) months, or by both such fine and imprisonment.
