A CHARTER ORDINANCE EXEMPTING THE CITY OF PEABODY, KANSAS FROM THE PROVISIONS OF K.S.A. 12-4112 AND PROVIDING SUBSTITUTE AND ADDITIONAL PROVISIONS OF THE SAME SUBJECT, RELATING TO THE ASSESSMENT OF COST IN THE MUNICIPAL COURT.
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF PEABODY, MARION COUNTY, KANSAS:
SECTION ONE. The City of Peabody, Kansas, by the power vested in it by Article XII, Section 5, of the Constitution of the State of Kansas, hereby elects to exempt itself from and make inapplicable to it the provisions of K.S.A. 12-4112 and provide substitute and additional provisions as hereinafter set forth in this Ordinance. Such reference provisions are either enactments or a part thereof which are applicable to this City but are not applicable uniformly to all cities.
SECTION TWO. There shall be a Ten Dollar ($10.00) assessment against each person found guilty in the Municipal Court in the City of Peabody, Kansas, that in addition thereto, there may be witness fees and mileage as set forth in K.S.A. 12-4411. Said fees as set forth above shall be designated as Court Costs.
