There is hereby incorporated by reference for the purpose of regulating all fuel gas work done or performed within the corporate city limits of the City of Peabody, Kansas the code known as the International Fuel Gas Code, 2006 Edition including appendices A, B, and C as recommended by the International Code Council, 5360 South Workman Mill Road, Whittier California, 90601, save and except such articles, sections, parts, or portions thereof as are hereinafter omitted, deleted, modified or changed. At least one copy of such publication shall be marked or stamped “Official Copy as adopted by Ordinance No. 16-2010, and shall be attached to a copy of said ordinance, or this code section, and filed with the city clerk and open for inspection and available to the public at all reasonable hours. All administrative departments of the city charged with enforcement of this code shall be supplied, at the cost of the city, such number of official copies, similarly marked, as may be deemed expedient.

The International Fuel Gas Code is hereby changed, altered, modified and otherwise amended as follows:

(a)   Section 101.1 of the International Fuel Gas Code is hereby changed to read as follows:

       Section 101.1 Title. These regulations shall be known as the Fuel Gas Code of the City of Peabody, Kansas hereinafter referred to as “this code.”

(b)   Section 106.5.2 of the International Fuel Gas Code is hereby changed to read as follows:

       Section 106.5.2 Fee Schedule. The fees for all fuel gas work requiring a permit shall be $15.00.

(c)   Section 106.5.3 of the International Fuel Gas Code is hereby deleted.

(d)   Section 108.4 of the International Fuel Gas Code is hereby changed to read as follows:

       Section 108.4 Violation penalties. Any person who shall violate a provision of this code or shall fail to comply with any of the requirements thereof or who shall erect, install, alter or repair work in violation of the approved construction documents or directive of the code official, or of a permit or certificate issued under the provisions of this code, shall be guilty of a misdemeanor, punishable by a fine of not more than five hundred dollars ($100) or by imprisonment not exceeding thirty days (30), or by both such fine and imprisonment. Each day that a violation continues shall be deemed a separate offense.

(e)   Section 108.5 of International Fuel Gas Code is hereby changed to read as follows:

       Section 108.5 Stop work orders. Upon notice from the code official, work that is being done contrary to the provisions of this code or in a dangerous or unsafe manner shall immediately cease. Such notice shall be in writing and shall be given to the owner of the property, or to the owner’s agent, or to the person doing the work. The notice shall state the conditions under which work is authorized to resume. Where an emergency exists, the code official shall not be required to give a written notice prior to stopping the work. Any person who shall continue any work in or about the structure after having been served with a stop work order, except such work as that person is directed to perform to remove a violation or unsafe condition, shall be liable to a fine of not less than one hundred ($100) dollars or more than five hundred ($500) dollars.

(f)   Section 109 of the International Fuel Gas Code is hereby deleted.

(g)   The International Fuel Gas Code is hereby changed by adding the following section:

       Section 104.9 Authority to disconnect. The building official, fire chief, or his designee shall have the authority to shut off the gas meter, where the same may interfere with the work of the fire department during the progress of an emergency or pose any other immediate hazard.

(h)   Section 309.2 of the International Fuel Gas Code is hereby changed to read as follows:

       Section 309.2 Connections. Electrical connections between equipment and the building wiring, including the grounding of the equipment, shall conform to the National Electrical Code as adopted by the city code.

All installations, connections, extensions, alterations and repair of gas pipes and gas piping systems connecting houses or structures of any character with the distribution system of the city, except such as shall be done by licensed plumbers or by the gas distribution company serving the city, shall be done only by such persons as have taken out a gas fitter’s license. Such license shall be issued by the City Clerk, upon application by a gas fitter. The fee for a license shall be Twenty-Five Dollars ($25.00) per year. The gas fitter securing a license shall furnish a bond in the same amount and subject to the same conditions as required of plumbers.
