The National Electrical Code (NFPA 70), 2005 Edition, a standard of the National Fire Protection Association, Batterymarch Park, Quincy, Massachusetts, 02269, the same being a standard code for the installation of electrical wiring and apparatus, shall be and is hereby incorporated by reference as the electrical code of the City of Peabody, Kansas. The said code shall constitute the minimum standards for all electrical work done or performed under the provisions of this article except as hereinafter provided. At least one copy of such publication shall be marked or stamped “Official Copy as adopted by Ordinance No. 15-2010,” and shall be attached to a copy of said ordinance, or this code section, and filed with the city clerk and open for inspection and available to the public at all reasonable hours. All administrative departments of the city charged with enforcement of this code shall be supplied, at the cost of the city, such number of official copies, similarly marked, as may be deemed expedient.

The National Electrical Code is hereby changed, altered, modified and otherwise amended as follows:
(a) Article 210.12 is hereby amended to read as follows:
Article 210.12 Arc Fault Circuit Interrupter Protection.
(a) Definition. An arc-fault circuit interrupter is a device intended to provide protection from the effects of arc faults by recognizing characteristics unique to arcing and by functioning to de-energize the circuit when an arc fault is detected.
(b) Dwelling Unit Bedrooms. All branch circuits that supply 125 volt, single phase, 15 and 20 ampere receptacle outlets installed in dwelling unit bedrooms shall be protected by an arc-fault circuit interrupter(s) of the combination type.
(b) Article 230.70 (A) is hereby amended to read as follows:
Article 230.70 (A) Location. The service disconnecting means shall be installed either inside or outside of a building or structure at a readily accessible location nearest the point of entrance of the service conductors.
Service disconnecting means shall not be installed in bathrooms.
Additionally, an outside service disconnect shall be required when either of the following conditions exist:
The distance from the Westar meter base to the service panel exceeds eight (8) lineal feet.
The distance from the entrance point of the service conductors to the service panel exceeds three (3) lineal feet.
(c) Article 334.10 is hereby amended to read as follows:
Article 334.10 Uses permitted. Type NM, Type NMC, and Type NMS cables shall be permitted to be used in the following:
One and two family dwellings
Multifamily dwellings permitted to be of Type III, IV and V construction
(A) Type NM. Type NM cable shall be permitted as follows:
For both exposed and concealed work in normally dry locations except as prohibited in section 334.10(3).
To be installed or fished in air voids in masonry block or tile walls.
(B) Type NMC. Type NMC cable shall be permitted as follows:
For both exposed or concealed work in dry, moist, damp or corrosive locations, except as prohibited by 334.10(3).
In outside and inside walls of masonry block tile.
In a shallow chase in masonry, concrete or adobe protected against nails or screws by a steel plate at least 1/16-inch-thick and covered with plaster, adobe or similar finish.
(C) Type NMS. Type NMS cable shall be permitted as follows:
For both exposed and concealed work in normally dry locations except as prohibited by 334.10(3).
To be installed or fished in air voids in masonry block or tile walls.
(d) Article 334.12 is hereby amended to read as follows:
Article 334.12 Uses Not Permitted.
(A) Types NM, NMC and NMS. Types NM, NMC and NMS cables shall not be permitted as follows:
In any structure not specifically permitted in 334.10 (1) and (2).
As service entrance cable.
In hoist ways or on elevators or escalators.
Embedded in poured concrete or aggregate.
(B) Types NM and NMS. Type NM and NMS cables shall not be used under the following conditions or in the following locations:
Where exposed to corrosive fumes or vapors.
Where embedded in masonry, concrete, adobe, fill or plaster.
In a shallow chase in masonry, concrete, or adobe and covered with plaster, adobe or similar finish.
Where exposed or subject to excessive moisture or dampness.

It shall be unlawful for any person, firm or corporation to place any wires of any kind or description in or about any building in the city which are intended for the purpose of conveying electric current for light, heat or power, except the electrical distribution company serving the city, without first having made application to the City Clerk and secured from him a license authorizing such person, firm or corporation to engage in the business of electrical wiring within the city. The fee for a license shall be twenty-five Dollars ($25.00) per year. Such license shall not be issued until said person, firm or corporation has made payment of the license fee and filed with the City Clerk a bond with good and sufficient surety executed to the City of Peabody in the sum of one Thousand Dollars ($1,000.00), and conditioned that the principal and his or its employees, agents and servants will comply with all of the ordinances of the city governing electrical wiring and installation and will hold and save the city free and harmless from all loss or damage to persons or property resulting from or arising out of the negligence or failure of such persons to use due care in performing any work for which such license is required.
